The Bureau discussed April 30-May 3 plenary agenda introduced by the Speaker, Irakli Kobakhidze.
MPs, within the Ministerial Hour, hear the Vice PM, Interior Minister Giorgi Gakharia and discuss up to 70 issues for consideration: bills, draft resolutions, Committee reports and Delegation reports.
The Bureau discussed the organizational issues concerning extension of consideration term of some bills and registration of the new initiatives.
The agenda includes the bill on State Inspector Service envisaging changed date of enactment, namely enactment date is being defined as May 1, 2019, July 1, 2019 and March 30, 2020.
MPs will discuss the draft resolutions by the Factions: European Georgia; European Georgia-Movement for Freedom; European Georgia-Regions envisaging termination of authority term ahead of time in High Council of Justice for Levan Gzirishvili, Zaza Kharebava and Shota Kadagidze due to their failure to exercise their duties.
“The Parliament elects the High Council of Justice members for due exercise of their authorities. These people are engaged in political debates and are prohibited from political or party affiliation. So, the Parliament shall discuss their expulsion from the Council”, - Elene Khoshtaria stated.
According to the Speaker, there is no ground to recall the HCJ member as they do exercise their duties.
“One of your arguments I fully share that the High Council of Justice member cannot be engaged in the political debates. However, this medal has another side – recall of the Council member is admissible only for undue exercise of his/her authorities, which is elucidated in various spheres, including in administrative law”, - the Speaker stated.
Such initiatives are very risky as allows arbitrary actions. “Such initiative is of the risky nature as it allows arbitrary actions and excessive impact of the political bodies on the High Council of Justice members, thus putting them to the risk. So, the law provides that only undue exercise of authorities shall serve as the ground for expulsion to prevent the Parliament or the President from arbitrary behavior. Today, we have on ground for expulsion as no undue behavior has been detected”.
These members of the Council have not made the political statements unlike Ana Dolidze, which is constantly engaged in political debates, however it cannot as well be considered as undue behavior.
