The Committee considered the package concluding the drafts on: organic law on Common Courts; Disciplinary Responsibility and Disciplinary Proceedings of the Judges in the Common Courts of Georgia; Civil Code of Practice; Administrative Code of Practice – facilitating to effective jurisdiction and reducing loaded agenda of the Judges.
According to the reporter, Gedevan Popkhadze, the drafts award the authority to the High Council of Justice to ensure stricter specialization of the Judges in the Court of Appeals. “The draft regulates exercise of authority of the Chair of the Court in his/her absence – in this case, the authority shall be exercised by the Deputy, and in absence of the Deputy – the Chair of one of the Chambers or the Investigation Board assigned by the Chair of the Court”, - he stated.
The drafts define the competence of the respective official (Master) of the Court, appointment and dismissal, as well as qualification requirements and disciplinary responsibility thereof.
“The respective official, similar to the Judge, is independent in his/her activity. The Judge evaluates the actual circumstances and makes the decisions solely pursuant to the Constitution, universally recognized principles of the International Law, other Laws and his/her belief. No one is entitled to require reporting from the Judge or to indicate to the specific decision-making on any certain case. The respective official of the Court shall not be deprived from case consideration, neither his/her authority shall be terminated ahead of time other than the events stipulated under the law”.
According to the Chair, Sofo Kiladze, it is continuation of the judicial reform. “The changes serve for protection of every person, every individual in the country”, - she stated. The Committee supported the package.
