The Chair, Eka Beselia wished happy New Year and merry Christmas to MPs and started with brief overview of 2017 and future plans. The Committee has developed most of the drafts, held most of the sittings and considered most of the drafts in 2017.
“Approximately 77-78% of the drafts submitted to the Parliament were considered by the Legal Committee, which gives a high load to the Committee, though we also have new and interesting formats for cooperation with international partner organizations. We are open for cooperation”.
The First Vice Speaker, Tamar Chugoshvili introduced with the II reading the drafts on: Legal Aid; and on Lawyers, aiming at accessibility to LEPL Legal Aid Service Bureaus and Advisory Centers, and enlargement of the civil-administrative directions. The drafts also aim at changes to the norms of law on Legal Aid that ensure higher efficiency of Legal Aid Council.
The drafts formulate the requirements for the Bar Association Council to lodge to the Legal Aid Council and establishes the rotation of the Council members – composition out of the Bar Association Executive Council and Public Defender independently shall be renewed with 1/3 annually. “As we considered the drafts with accelerated manner but due to overload of the Committees and the busy plenary agenda, we failed to adopt the laws, the terms shall be changed from January 1 to March 1”, - T. Chugoshvili stated.
Term specification depends whether the Parliament convenes the extraordinary session. The Committee supported the drafts. The Committee considered the draft organic law on Common Courts entitling the High Council of Justice to ensure stricter specialization of Judges in the Court of Appeals.
The draft regulates functions of the Chair of the Court in his/her absence – to be exercised by the Deputy, and in absence of the Deputy – by Chair of the one of the Chambers or Investigation Board.
According to E. Beselia, the draft defines competence of the respective employee, his/her appointment and dismissal and qualification requirements. He/she may be called the assisting Judge. “He/she shall be authorized to consider the cases only such are recognition of missing and declaration of dead, plus banks, micro-financial organizations, non-bank deposit institutions, e-agreements and mortgage if the dispute does not exceed 5000 GEL”. The Committee supported the draft.
The Committee considered with the I reading the draft by Emzar Kvitsiani on Georgian Citizenship, envisaging simplified citizenship to ethnic Georgians abroad. The Committee is committed to set up the working group for regulation of related standards. “We offer you to be involved in the group and coordinate it”, - E. Beselia stated.
E. Kvitsiani recalled the draft. The Committee considered the issue of set up of the Scientific-Advisory Council under the Article 54 of the Rules of Procedure. E. Beselia introduced the estimated rules of the Council.
