The Committee considered with the II reading the draft on Civil Code, admitting marriage of minors of 17 with the consent thereof and on the basis of the court approval with the reason such is birth. The norm is to be enacted on January 1, 2016. The changes increase minimal marriage age from 16 to 17 and define parents and guardians to no longer be authorized to issue approval on marriage. The draft specifies the basis of marriage. Regulation of this issue is the transitional period norm and shall be declared void in a year upon enactment, implying that the Civil Code, for this period, shall define the minimal marriage age as 18, thus prohibiting minors to marry.
The Committee considered with the III reading the draft on Notary, redefining rules and terms of appointment of notary – newly appointed notary shall, within the first 3 years, serve in highland region or in the settlement with no access to notary service. The draft defines financing by the Chamber of Notaries.
The Committee considered with the I reading the draft on Amnesty, applying to the persons, committing the crime under the Criminal Code (fraud, fabrication of documents, bribery, abuse of official authorities), related to fabrication or illegal use of ID, residence permit, passport, travel documents, record of the civil act, registration of civil act, other official documents under competence of the state service development agency and/or refugee certificate. Amnesty shall apply to the persons, committing the hereof crimes before January 1, 2009.
The Committee considered with the I reading the draft on Code of Administrative Offenses. The draft specifies the types and sanctions for concrete offenses, such are: violation of license on usage of minerals, sea pollution, vehicle wash in the sea, lake, reservoir, river or surface waters or violation of terms under ecologic expert opinion, violation of environmental protection technical rules with illegal obtainment of fauna and flora, wild animal derivatives etc. The draft defines responsibility for the actions such are: illegal trade of the derivatives of species of wild flora and fauna included in the international trade convention, illegal export, import, re-export and introduction from the sea (including violation of permit), violation of norms of composition of the diesel or qualitative norms of petroleum defined by the Government upon import, storage and supply of fuel on Georgian territory etc.
The Committee supported the drafts.
The Committee did not support the draft organic law on Election Code defining additional measures to provide gender balance in the Parliament – the norm is to be added, envisaging the proportional list of participation in the Election to provide every third candidate as female. It will provide at least 23 female MPs in the Parliament.
