The Committee considered with the I reading the drafts by the Legal Issues Committee on: organic law on Common Courts; Disciplinary Responsibility and Disciplinary Proceedings of the Judges of the Common Courts; Civil Code of Practice; Administrative Code of Practice, introduced by Eka Beselia.
According to her, the drafts have been the working group on the judicial reform and they are conditioned with necessity to prevent protraction of case consideration in the Regional (City) Court and Court of Appeals and for rapid and effective jurisdiction.
The drafts aim at better protection of interests of the parties, reduction of load on the Judges etc. The changes define the legal basis for stricter specialization in the Court of Appeals. Unlike the City Courts, the organic law fails to provide stricter specialization in the Court of Appeals although the high flow of cases constitutes a problem.
Thus, it is expedient to consider the agreements concluded by the Banks, micro-financial organizations and non-bank deposit institutions, the required amount of which does not exceed 5000 GEL, by the respective Master of the Court. It will facilitate to unloading of the Court.
Adoption of the drafts will entail allocations from the state budget and they will have the following impact on expenditure: 3 employees (masters) for Tbilisi City Court for consideration of hereof agreements with the salaries of 1690 GEL. The annual amount constitutes 81 120 GEL.
The Committee, including the opposition MPs shared the general principles stating that the idea is good and offered to increase the number of the employees. Thus, the Committee supported the drafts.
