The persons, accused of one and the same criminal offence will be placed in separate cells. The administration shall undertake all relevant measures to provide separation of these persons. The change, which shall be introduced to the Criminal Code of Practice, was considered by the Committee. According to the current legislation, in the event, if there is no special decision by the investigator, prosecutor or court, the persons, accused of the same crime are placed in one area. According to the Chairperson of the Committee, Eka Beselia, deriving from the interests of investigation, placement of such persons together is not expedient as there is high risk of pressure on each other. “The decision by the European Human Rights Court on the case “Enukidze and Girgvliani against Georgia”, indicates to the gaps, existing in the Code, in which the European Court on Human Rights condemns the fact of placement of 4 persons, accused of same crime, in one cell”, - she stated. The Committee members supported submission of the draft law to the plenary session. |
