The Committee considered with the first reading the draft by legal committee: on change to the Criminal Code of Practice. According to the draft, the persons shall be granted right to appeal the court decision for violation of order and failure to implement procedural duties, who were imposed with the responsibility to pay penalty or be expelled. The court is entitled to make the decision without verbal hearing though there is possibility of single appeal. The appeal will be considered by the court under the procedure for appeal of the decision on detention. The Committee considered with the first reading the draft by the inter-faction group on change to the Election Code of Georgia. The voting procedure on mobile box will not be held on the voting day for the electors residing in other countries. According to the changes, the biometrical registration of electors will be implemented for the elections of 2014 municipal. The draft by Vakhtang Khmaladze redefines the list of the subjects, nominating the candidate for Public Defender. The Committee considered with the first reading the draft on change to the Organic law on Public Defender, according to which, the right to nominate the candidacy upon oath by the newly elected President remains to the Faction and the group of at least 6 MPs. According to the draft, in the event of insufficiency of response means, the PD will have possibility to make the written address to the President and the Prime Minister. The Committee considered with the first reading the draft by Tamar Kordzaia and Giorgi Kakhiani on change to the law on Deprivation of Property for Necessary Public Needs, defining the terms of expropriation and compensation. According to the draft, upon deprivation of property, the compensation shall be in advance, full and fair and free of taxes and fees. The Committee supported the drafts to be submitted to the session.
