The Committee discussed the resolution, adopted at the summit, organized by the organization “Former Prisoners for Human Rights”, envisaging judgment of former government. The resolution provides appeal to the Parliament to set up the ad hoc fact finding commission to study the crimes by UNM and give the relevant moral and legal evaluation. It is noted that people choose to restore justice on October 1 and people demands to judge the former government. The resolution is signed by 12 000 people. Otar Chrdileli was interested in the reason of absence of minority members. According to Eka Beselia, minority was informed though they frequently are absent at the sittings. The Committee considered the statement by the former judges of the Criminal Chamber of the Supreme Court: Merab Turava, Nino Gvenetadze, Tamar Laliashvili and Murman Isaev on termination of their authority ahead of time. They indicated that they were subject under illegal disciplinary persecution during the former government, on the basis of which the authority was terminated ahead of time for Merab Turava under the resolution of November 10, 2006, for Nino Gvenetadze – under resolution of November 24, 2006, for Tamar Laliashvili – under resolution of November 10, 2006 and for Murman Isaev – under resolution of November 10, 2006. According to M. Isaev, the Venice Commission supposed in the opinon of March 19, 2007 №408/2006 that it was abuse of independence of the judges. The German and Georgian professors gave the critical evaluation to the disciplinary persecution and the organization MEDEL, adopted the resolution on June 16-17, 2006, giving the negative evaluation to their dismissal ahead of time. It is noteworthy that former judges appealed to the European Court of Human Rights. “Besides illegal interference in decision making, there were multiple psychological pressure on the judges to force them retire”, - M. Isaev stated. He asked the Committee to have a relevant response.
