The person, committing the crime under the article 339 of the CCG implying bribery; under the article 362, implying the preparation or usage of bad document, false seal, stamp or form and under 363, implying illegal appropriation of the document, seal, stamp or form, shall be exempted from criminal responsibility according to the law on Amnesty considered with the first reading. Amnesty shall apply to the persons only who committed the crime before January 1, 2009. At that the person shall be exempted from reimbursement of damage to the state. If no prosecution is onset towards person, he/she must apply to the agency or the diplomatic representation of Georgia abroad. If the person possesses the false IDP certificate, he/she must apply to the Ministry of Refugees. The person under criminal proceedings though without sentencing yet, shall be exempted from criminal responsibility. The Committee members expressed remarks that amnesty shall apply to the persons only to whom the prosecution has not been onset. The MPs presume that if amnesty applies to the persons to whom the sentence has not been made, then it must apply to the persons who already is convicted for the crime. The Committee considered it wrong the amnesty to apply to the persons only who committed the crime before January 1, 2009. The Committee also considered with the I reading sundry drafts to be harmonized with the Constitution entailed with the changes subject to enactment upon the oath by the newly elected President in 2013: changes to the organic law on National Security Council; change to the Election Code; change to the law on Protection of the Population and the Territory from Natural and Man-caused State of Emergency and changes to the law on Structure, Authority and Activity Rule of the Government. The Committee will resume discussing the change to the Code of Administrative Offense with the II reading tomorrow. |
