The Legal Issues Committee discussed the Draft Election Code

The Committee discussed for the I reading and approved the Draft Election Code. Pursuant to the Draft, if the Central Election Commission fails to make a decision after voting, the adoption of which requires the votes of at least 2/3 of the full composition of the CEC, the same decision shall be re-voted at the same sitting. In this case, the CEC decision shall be considered adopted if approved by the majority of the full composition.


The Draft envisages that the activity of a temporary member of the District Election Commission (DEC), the auxiliary or technical personnel of the DEC, and a member of the Precincts Election Commission (PEC), and/or their remuneration shall not affect the registration of their socially vulnerable families in a database with the prejudice thereto, provision of the social aid, social allowance and/or state allowances therefor, the application of the social preferences and/or participation in the state employment program and/or subprogram.


Yet another amendment annuls the CEC advisory group, which, pursuant to the Election Code, shall be established for an electoral period within a term of 10 days upon the appointment of the elections. As the reporter, the First Deputy Chair of the Committee, David Matikashvili elucidated, practice reveals that the advisory group, starting from 2020 up-today, has never executed any of its functions.


“For instance, the advisory group members refused to participate in the sittings in 2020, which entailed that the existence of the group is now put under doubt due to its failure to operate”, - he stated.
