
The Legal Issues Committee supported, in the first reading, amendments to the Civil Code of Georgia aimed at bringing the Civil Code into compliance with a decision of the Constitutional Court of Georgia.
According to the presenter, First Deputy Chair of the Procedural Issues Committee Akaki Aladashvili, the amendment concerns Article 1343(1) of the Civil Code of Georgia, which regulates the transfer of ownerless property into state ownership.
According to him, on September 19, 2025, the Constitutional Court of Georgia, in the case “Giorgi Khorguashvili v. Parliament of Georgia,” declared unconstitutional, in relation to Article 11(1) of the Constitution of Georgia, the wording of Article 1343(1) of the Civil Code stating: “and if the decedent had been under the care of a specialized institution for elderly persons or persons with disabilities, another social protection institution, or a medical or educational institution — into the ownership of the relevant institution”.
According to the draft law, Article 1343(1) of the Civil Code has been revised to read as follows: “If there are neither heirs by law nor heirs by will, if no heir has accepted the estate, or if all heirs have been deprived of the right of inheritance, ownerless property shall become the property of the State”.
