The Legal Issues Committee deliberating on the Draft Organic Law on the Prosecution Office

The Legal Issues Committee discussed for the I reading and approved the Draft Organic Law on the Prosecution Office with the companion Bills, introduced by the Chair of the Committee, Archil Gorduladze.

The Draft annuls the Law on Special Investigation Service, as well as the Special Investigation Service and the positions of the Chief of Service, his First Deputy and the Deputy. The amendments envisage the indemnification for the aforementioned officials and the officers of the Service.

The criminal cases undertaken in the Special Investigation Service’s subordination will be delegated to the independent constitutional body, the investigation unit of the Prosecution Service, unless the aforementioned criminal offences were committed by a Prosecution Service officer.

The Draft envisages the obligation of the Government to ensure the remedies necessary for the liquidation of the Service, also for the disposal of the assets on the balance of the Service and the respective documents.

“The investigative authorities of the Prosecution Office shall encompass the mandate previously granted to the Special Investigation Service. The amendments safeguard that the investigation shall be conducted by an impartial and independent body, the independence standard of which is based and guaranteed under the Constitution”, - A. Gorduladze noted.

According to him, the amendments also eliminate the vagueness concerning the status of the Service and ensure the capacity of independent investigations.
