The Legal Issues Committee endorsing the Draft Organic Law on the Prosecution Office

The Legal Issues Committee deliberated and approved the Draft Organic Law on the Prosecution Office for the I reading, introduced by one of the initiators, the Chair of the Committee, Archil Gorduladze.

As per the reporter, the applied Organic Law perplexes the election of the Prosecutor General by the nomination and selection regulations.

The amendments address the gaps pertaining to the nomination and appointment of candidates for the Prosecutor General and establish an effective model.

As the reporter elucidated, the Prosecution Office enjoys the authority, safeguarded under the Constitution, to nominate a candidate for the Prosecutor General; however, the Law with a lower hierarchy envisages the one-month consultations with civil society, organizations and academic circles. Henceforth, three candidates shall be shortlisted and the candidate winning 2/3 of the votes will be nominated to the Parliament.

“The primary flaw in this procedure is that other entities are already engaged in the execution of the authorities mandated by the Constitution, which is counterproductive. Consequently, the proposal suggests that the Prosecution Office should enforce its authority without external interference and that each member should be entitled to nominate one candidate. The candidates will be presented to the Prosecution Office. The voting will be conducted openly, and the candidate who receives the support of the majority of the full composition will be nominated for Parliament. The Parliament, henceforth, makes a decision to approve or decline the candidate”, - he stated.

The Committee approved the Draft Organic Law, initiated by MPs Archil Gorduladze, Tornike Cheishvili, Alexander Tabatadze, David Matikashvili, Rati Ionatamishvili, Aluda Gudushauri, Tengiz Sharmanashvili, Guram Macharashvili and Akaki Aladashvili.
